Terms and Conditions
Customer’s signature on the Rental Agreement states that the Renter confirms and accepts that he/she has read these Conditions, and agrees with them. The Conditions of the rental and the Rental Agreement are considered inseparable.
Driver's Required Qualification
Vehicles can be rented by the drivers who are aged at least 25 years old and have at least one year of driving experience.
In order to rent a car the renter must present a valid driving license and valid insurance.
Authorized Drivers of the Vehicle
As per the Rental Agreement, only the Renter is authorized to drive vehicle. Other drivers can be registered as additional drivers. Additional drivers should present a valid driving license.
The Renter acknowledges and confirms that he/she will not permit anyone to drive the Vehicle:
A) who is not authorized by the Westbound Adventures staff and is not registered in the Rental Agreement as an additional driver.
A) who does not meet the minimum requirements of Westbound Adventures and official state law regarding driver’s age, validity of driving license and/or any other minimum requirements;
B) Who is under alcoholic influence, narcotic or any other stuff affective consciousness or ability to react, or who is exhausted.
In case of breach of this clause the Renter remains responsible for the whole damage and its circumstances.
Responsibility for Property
Westbound Adventures takes no responsibility for the items or belongings left or forgotten in the rented vehicle. Renter should check the inside of the vehicle carefully before returning or at the moment of return.
Accidents, Theft, Vandalism and Damages,
A) The Renter must immediately inform about road accident, scratches, crash, theft of the Vehicle or any stolen parts and/or any other incident the Vehicle is involved.
B) Without Westbound Adventures’ permission and the police presence the Renter must not accept any liability or release the other part of the accident on his sole decision. The Renter must immediately report the company, police and the insurance company about the accident and follow the further instructions. If the Renter does not follow these instructions, then he/she remains fully responsible for the damage and the circumstances. The Westbound Adventures team is always there to assist.
C) If an accident happens or in case of theft and/or vandalism, the Renter must immediately report the police and the company and at police presence fill all the necessary documentation. Upon returning the rental vehicle the Renter must provide the copy of the protocol filled at the moment of the accident. If the police protocol misses, then the Renter remains fully responsible for the damage.
D) The Renter must keep the Vehicle keys, official documents, remote control and anti – theft system safely. If the vehicle is stolen, the Renter will be required to return all these belongings to Westbound Adventures representatives.
E) The Renter must closely cooperate with Westbound Adventures, Police and with the insurance agency to help in the investigation of the traffic accident/loss/vandalism.
If the Renter ignores this clause and does not fulfill the requirements, he/she will remain fully responsible both financially and legally.
F) In case of some obstacles such as darkness, weather conditions, time and/or place of the Vehicle return, vehicle uncleanness and it makes impossible for Westbound Adventures representative to define the loss of Vehicle parts and/or damages, then Westbound has the right within 48 hours to charge for loss or damage if such is discovered.
Parking Fees and Traffic Tickets
A) By putting the signature on the Rental Agreement the Renter confirms that he/she takes the full responsibility for all traffic and parking fines occurred during the rental agreement and any other breach of law and its consequences.
B) If the Renter gets traffic or parking fines during his/her rental period, he/she must present the ticket to the Westbound Representative with the payment confirmation.
C) If the fines described in paragraph <<PARKING / TRAFFIC FINES >>(A) are received after the rental and covered by Westbound Adventures, the Renter must compensate to Westbound the full amount of the ticket, taxes plus reasonable administrative charges.
D) At any time Renters may request Westbound Adventures to provide him/her with a copy of rental agreement, police ticket and the receipt that those have been paid off.
Personal Data
When the signature on the Rental Agreement, the Renter acknowledges and accepts that he/she knows that Westbound Adventures may use his/her personal data according to Westbound’s needs that include statistical analysis, credit check and protection of Westbound’s property. If the Renter breaches the Rental Agreement clauses or state law upon legal bodies’ request Westbound has the right to share the available information publicly and forward it to third parties.
One-Way Rentals
Westbound Adventures does not allow one-way rentals.
Delivery and Collection of the Rental Vehicle
A) Westbound Adventures provides vehicles to the Renters in operating and overall good conditions, clean and with a full tank, complete with all necessary documents.
B) The Renter agrees to return the Vehicle to Westbound Adventures according to the information stated in the Rental Agreement, in the same condition as before the rental taking into the consideration the natural tear and wear, returning the same documents and extra equipment.
C) The Renter will review the condition of the Vehicle when supplied by the supplier, and by signing, will agree that it matches to the description given in the Vehicle Delivery/Acceptance protocol which is inseparable part of the Rental Agreement. The Renter confirms that during the rental he/she will be responsible for the careful use according to the technical description of the Vehicle, documents and additional accessories and for safe driving.
D) The Renter must return the Vehicle to the Westbound Adventures location (or any other) designated in the Rental Agreement within the working hours of the location. If The Renter drops off the Vehicle out of the estimated working hours he/she must fulfill with the out-of-office-hours return terms for that location. If the Renter returns the Vehicle within out of office hours time framework he/she remains fully responsible for the Vehicle until Westbound personnel takes possession of it by signing on the Delivery/Acceptance Protocol.
E) If the Renter does not return the Vehicle to the mentioned return location/place at the time stated in the Rental Agreement, Westbound Adventures will charge an additional day's charges to the rental amount after one hour of delay. If the Renter fails to return the Vehicle to the agreed point, or if it is out of hours’ time, he / she will be fully responsible for the delivery or out of hours charges.
F) The Renter is obliged to pay a supplementary cleaning fee of $250.00 if the Vehicle requires a more thorough than Westbound Adventures standard inside and outside cleaning at return.
If the vehicle is returned with less tank than fixed in the Rental Agreement at the moment of pick up the Renter is fully responsible for the charges. Additional fee of $10 will apply per each missing gallon.
The Renter may request to prepay for the full tank at the moment of pick up and return the vehicle with an empty tank. Fuel not used by the time of the Vehicle's return will not be refunded.
Please note that this is not a sale of fuel.
Prohibited Use of the Car
Neither you nor any authorized operator may:
permit the use of the car by anyone other than you or an authorized operator;
intentionally destroy, damage or aid in the theft of the car;
take or attempt to take the car into Mexico or Canada or to anywhere else outside of the United States except as expressly permitted under this agreement;
engage in any willful or wanton misconduct, which, among other things, may include reckless conduct such as: the failure to use seat belts, the failure to use child seats or other child restraints where legally required, use of the car when overloaded or carrying passengers in excess of the number of seat belts in the car, use on roads which are not regularly maintained, refueling the car with the wrong type of fuel, i.e., Diesel in a Gasoline Engine or Gasoline in a Diesel Engine, leaving the car and failing to remove the keys, or failing to close and lock all the doors, car windows or the trunk;
Use or permit the use of the car by anyone:
while legally intoxicated or under the influence of alcohol, drugs or other absorbed elements which may adversely affect a person’s ability to drive safely;
for any purpose that could properly be charged as a crime, such as the illegal transportation of persons, drugs or contraband or any direct or indirect act of terrorism involving the causing or threatening of harm of whatever nature and by whatever means made or claimed to be made in whole or part for political, religious, ideological, or similar purpose;
to tow to push anything;
in a speed test, speed contest, race, rally, speed endurance contest or demonstration;
in driver training activity;
to carry persons or property for hire (i.e., for a charge or fee), unless specifically authorized in writing by Westbound Adventures;
if the car has been obtained from Westbound Adventures by fraud or misrepresentation; or
to carry hazardous materials (other than customary quantities of materials used in the operation of the car that are stored within the containers provided for them), explosives, biologically active materials that are hazardous to human health or radioactive material including, but not limited to, any biologically active or radioactive material for research, education, development or industrial purposes, or for purposes incidental thereto;
Any use of the car in a manner prohibited in the above paragraph:
to the extent permitted by applicable law, will cause you to lose the benefit of any limitations on your liability for loss of or damage to the car, even if you have accepted the Loss Damage Waiver.
To the extent permitted by applicable law, void personal accident insurance and personal effect coverage, liability insurance supplement, emergency sickness protection and any liability protection provided by Westbound Adventures under this agreement; and
will constitute a breach of this agreement, making you responsible, to the fullest extent permitted by law, for the actual and consequential damages to Westbound Adventures caused by the breach, together with Westbound’s related costs and attorneys’s fees.
Onboard Tracking Devices and Data Use Notice
The car may be equipped with global positioning technology or other telematics systems and a transmitter that allows Westbound Adventures to track or otherwise locate the car and privacy is not guaranteed. You acknowledge that the data derived from the in-car telematics and other devices may contain personal information and you authorize Westbound Adventures to share that data with the device manufacturer, the original equipment manufacturer and its affiliates
(collectively, “OEM”), service providers, and other Third Parties to whom Westbound Adventures or OEM grants data access. To the extent permitted by law, you authorize Westbound Adventures, the device manufacturer’s, OEM’s, service provider’s, and other Third Parties to whom Westbound Adventures or OEM grants data access of the technology included in the car, including to the track the location of the car, to disable the car and to assist in the repossession of the car.
It is your responsibility to delete any Bluetooth synced data from the car upon your return. You acknowledge and agree that, to the extent permitted by applicable law, Westbound Adventures may collect, process, charge on the basis of the data derived from in-car telematics and other devices and gauges. Actions may include suspension or termination of your ability to continue to rent cars from Westbound Adventures. You authorize Westbound to provide personal information about you and each rental you undertake using and identifying customer program number.
The car may have telematics, tracking, and related services in which case you understand that your access and use of the car or the services are subject to the car, service provider’s or the device manufacturer’s term and privacy statement, which may include other terms, service limitations, warranty exclusions, limitations of liability, wireless service provider terms and privacy practices.
Validity of the Conditions
A) Westbound Adventures reserves the right at his sole decision to change or amend the Conditions unilaterally and without prior notice.
B) Any controversies between Westbound Adventures and the Renter will be settled between the parties during the negotiations. If a settlement cannot be reached, then the dispute will be passed to the Gallatin County Court according to the legislation of Montana.
